1 Introduction

These Terms of Use govern access to and use of Witzzart, including the website, listings, booking flows, creator tools, account features, content, support channels, and any other services or functionality that may be made available by Witzzart from time to time. By accessing or using Witzzart, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the platform.

Witzzart may update these Terms from time to time. The version posted on the platform at the relevant time will apply to your use of the platform, subject to any rights or obligations that must be preserved under applicable law.

2 Platform Role

Witzzart is a technology platform that enables independent creators to list and sell creative experiences, events, services, and related offerings, and enables users to discover, book, purchase, and participate in those offerings. Witzzart is not itself the organizer, host, seller, venue operator, performer, service provider, or event owner for the majority of listings published on the platform unless Witzzart expressly states otherwise in writing.

Each listing is created and managed by the relevant creator, and the transaction for that listing is between the user and the creator, subject to these Terms and the applicable platform policies. Witzzart provides the platform infrastructure, communication pathways, support process, payment handling, and related operational tools, but does not replace the creator's own responsibility for the offering.

3 Eligibility and Capacity

Users may use the platform only if they have the legal capacity to enter into a binding agreement under applicable law. Where a listing has an audience restriction, age condition, attendance condition, or other suitability requirement, users are responsible for reviewing that information before booking. Users are also responsible for ensuring that any booking they make is appropriate for themselves or for the person on whose behalf the booking is being made.

If a user is not certain whether an experience is suitable, the user should use the official support channel before completing the booking. Witzzart may rely on the listing information provided by the creator and on the information submitted by the user for the purpose of operating the platform and handling support requests.

4 User Account Responsibility

Users must provide accurate, current, and complete information when creating accounts, making bookings, submitting requests, or communicating through the platform. Users are responsible for maintaining the confidentiality of their account credentials and for all activity carried out through their account. If a user believes that an account has been compromised or used without authorization, the user should contact the official support email address as soon as possible.

Witzzart may suspend, restrict, or terminate access where it reasonably believes an account has been used in violation of these Terms, platform policies, applicable law, or any conduct standard that protects the platform or its community.

5 Creator Responsibility

Creators are responsible for the content and accuracy of their listings. A creator must ensure that the title, description, date, time, location, pricing, inclusions, exclusions, audience suitability, attendance limits, media conditions, and any special terms are truthful and not misleading. Creators must not publish a listing unless they have the practical ability and the necessary permissions to deliver what is being offered.

Creators are responsible for the lawful use of any content, image, video, music, name, branding, artwork, venue reference, collaborator reference, or other material used in their listing or profile. Creators are also responsible for ensuring that their offerings comply with applicable law, local venue requirements, safety expectations, and any other permissions needed for the experience to be hosted or delivered.

6 User Conduct

Users must use Witzzart in a lawful and respectful manner. Users must not misuse bookings, impersonate others, harass creators or participants, disrupt events, attempt to bypass payment flows, submit false complaints, or use the platform for fraudulent, abusive, or harmful conduct. Users must not book an experience with no intention of attending or use the platform in a way that burdens creators or the support system unfairly.

Users must also not upload or submit material that is unlawful, infringing, deceptive, obscene, hateful, abusive, or otherwise inconsistent with platform standards. Witzzart may take action where it reasonably believes the platform is being misused or where conduct creates risk for users, creators, the platform, or the community.

7 Creator Conduct

Creators must avoid fake listings, false claims, abusive communication, manipulation of bookings, misuse of user data, or any conduct that harms trust in the platform. Creators must not pressure users to avoid support, must not manipulate the refund process, and must not interfere with a user's legitimate right to raise a concern through the official support channel.

Creators are expected to maintain a professional standard of communication with users and with Witzzart support. They are also expected to respond reasonably to booking questions, attendance issues, event changes, and support-related review requests when they arise.

8 Payments and Payouts

All payments made through the platform are processed using the payment methods and third-party service providers made available at checkout or through the platform's operational systems. Users may be charged the listed price for the offering, along with any platform fee, taxes, or payment-related charges displayed during checkout or otherwise disclosed by the platform.

Creators may receive payouts after completion or successful delivery of the relevant experience or service, subject to deductions, adjustments, holds, compliance checks, and payment processing requirements. Payouts are typically processed within three to five working days after successful completion, unless a hold, dispute, review, or other operational issue applies.

Witzzart may delay, withhold, review, or adjust payouts where there is a dispute, suspected fraud, a policy issue, an incomplete registration record, a payment processor issue, a compliance concern, or another reason that requires review. Witzzart is not responsible for delays caused by incorrect banking information, third-party processor issues, network failures, or other matters outside our reasonable control.

9 Refunds and Cancellations

Refunds and cancellations are governed by the relevant platform policy and the information shown on the listing, if any. Unless a specific listing states otherwise or a platform decision is made in a particular case, refund and cancellation requests must be handled through the official support channel and will be reviewed case by case.

Users and creators understand that the platform does not guarantee the approval of any specific refund or cancellation request. Platform fees are generally non-refundable unless otherwise stated or required by law, and payment processing charges may be treated separately where they have already been incurred.

10 Photography and Media

By attending or participating in an experience listed on Witzzart, users understand that the event may involve photography, videography, or recording unless the listing expressly states a different rule. Creators may set special media conditions in the event description, and those conditions apply when clearly disclosed.

Users are responsible for reading the relevant listing before booking and for respecting any media condition stated there. Creators are responsible for ensuring that any media-related limitation they set is stated clearly and consistently in the listing.

11 Content and License

Creators retain ownership of their original content unless otherwise agreed in writing. However, by uploading or submitting content to the platform, creators grant Witzzart the right to display, host, reproduce, and use that content for platform operation, listing presentation, promotional activity, and related business purposes, subject to applicable law and the creator's rights.

Users and creators must not upload content that is unlawful, infringing, deceptive, obscene, hateful, or otherwise inconsistent with platform standards. Witzzart may remove or restrict content where it reasonably believes such action is needed to protect the platform, its users, or its legal position.

12 Disclaimer and Limitation of Responsibility

The platform is provided on an as-available basis. Witzzart does not guarantee uninterrupted service, error-free operation, or the accuracy, completeness, or availability of every listing or feature at all times. To the fullest extent permitted by law, Witzzart is not responsible for the conduct of independent creators, the delivery or quality of third-party experiences, venue issues, weather, travel disruptions, user behavior, or losses arising from circumstances beyond our reasonable control.

Users understand that participation in creative experiences may involve ordinary risks associated with the nature of the activity, and that Witzzart is not the direct operator of the majority of listings on the platform. Nothing in these Terms is intended to exclude liability where such exclusion would not be permitted by applicable law.

13 Suspension and Termination

Witzzart may suspend, limit, or terminate access to the platform, specific features, content, listings, or accounts where it reasonably believes such action is needed to protect the platform, enforce these Terms, manage disputes, address abuse, respond to legal concerns, or maintain a safe environment. Witzzart may act without prior notice in urgent matters involving fraud, safety, serious abuse, or significant policy breach.

14 Support and Communication

All queries, disputes, refund requests, cancellation requests, account concerns, and policy questions should be sent to the official support email address shown on the platform. The platform's standard response target is 24–36 hours, though actual response time may vary depending on the nature of the request and the volume of support received.

15 Governing Law

These Terms are governed by the laws applicable in India. If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue in effect.
